PREFACE
The book provides detailed insights regarding methods and conditions that are generally encountered during the settlement of the international investment disputes. A detailed analysis of the jurisdiction process is also provided, to develop a greater understanding of the given topic.
The circumstances surrounding the domestic means of dispute resolution in host countries such as; low confidence level of foreign investors, the impossibility of bringing individuals before international courts of law in their own right and the consequent impact of the circulation of foreign private capital have led to the condemnation of a large number of States against utility of arbitration as an alternative means to resolve investment disputes. The individual acceptance for the adoption of arbitration system as a useful source of settling disputes between host and investing countries without interference (the State of nationality) has been a recent and significant development in dispute settlement, contributing towards the influx of foreign investment, the proliferation of economic development agreements and the development of international trade.
